Terms and Conditions of Sale

1. Legal

Red Balloon Trading CIC is the wholly owned trading subsidiary of Birmingham Children’s Hospital Charities (Registered Charity Number 1074850) and as such Gift Aids all its profits to the charity at financial year end.  Red Balloon Trading CIC is a community interest company limited by guarantee, registered in England and Wales No. 05996296.

2. Processing your order and payment

2.1 We accept payment by MasterCard, Maestro, Visa, and American Express.  Card transactions are processed on our behalf by PayPal which does not disclose your card details to us.  Cheques and postal orders are accepted for postal orders only and should be made payable to Red Balloon Trading CIC. Cheques should be crossed and have your address (including postcode), cheque card number and card expiry date written on the back. Please do not send cash through the post. CAF cheques are only acceptable only for making a donation and not if purchasing any product, including virtual gifts.

2.2 All product prices and delivery charges shown in our gift catalogue and on our website are inclusive of United Kingdom VAT and are correct at the time of printing.

3. Goods

3.1 All orders will be subject to our acceptance of the order

3.2 Due to popular demand and occasional limited availability, our products may sell out quickly.  If an item you have ordered is not available you will be notified.

3.3 Although we aim to describe and measure items as accurately as possible, occasionally colours, design and materials may vary slightly from those illustrated.

3.4 The donation amounts of our alternative gifts suggest how Birmingham Children’s Hospital Charities could spend your money.  However your donation helps the full range of our work at the Hospital and will be used where the need is most urgent.

3.5 If items within your order are permanently out of stock, we may at times substitute your item for a similar product of equal or greater value. If you do not wish to accept this substitute you may return it to us and we will issue you with a full refund.

4. Delivery

4.1 Your order should arrive within 7-10 days, but please allow up to 28 days for delivery at peak times.

4.2 We cannot accept liability for out of pocket expenses or other costs incurred due to failed or delayed deliveries or breach of our obligations, if the delay or breach is due to acts of God, civil commotion, riots, strikes, malicious damage, floods, drought, fire, flood, legislation, failure of ISP or telecommunications provider or other cause beyond our reasonable control. This does not affect your statutory rights.

4.3 If you select the next day delivery option by telephone or via an internet order, where stock is available, your order must be placed by 1pm Monday-Thursday to receive your order the next working day. Orders placed by 1pm on Friday will be delivered on the following working Monday and orders placed over the weekend will be delivered on the next working Tuesday.

4.4 A postage and packing fee is not applicable for donations or the purchase of alternative gifts where other items are not included.

4.5 For overseas deliveries, or those to the Highlands and Islands, please call our customer services team for full delivery charges on 08000 302 304 .

4.6 Where applicable, specific delivery information will be included in the product description.

5. Cancellation and refunds

5.1 You have the right to cancel your order for any reason within 14 days or receiving your items. Where you are withdrawing from your purchase within the 14-day cooling-off period we will be happy to refund an item once we have received the items back, assuming they are in fully re-saleable condition. Postage for returning the item to us will be at your own cost. If the items are not in a fully re-saleable condition we do reserve the right to refuse a refund. This does not affect your statutory rights.

5.2 If you receive damaged products or we send a product in error or we supply you with a substitute for a product which is unavailable and you do not want the substitute please call the customer service team. You may return the products and a replacement or full refund will be provided, including the costs of returning the product to us.

6. Data protection

6.1 The information provided by customers will be held by Birmingham Children’s Hospital Charities and Red Balloon Trading CIC for processing and administrative purposes in accordance with the Data Protection Act 1998.

7. Gift Aid

7.1 If you pay UK Income Tax and/or Capital Gains Tax and you any part of your payment is a donation to Birmingham Children’s Hospital Charities you will be invited to make a Gift Aid declaration so that we can claim the basic rate tax you have already paid on the donation (25p per £1 donated at 2010-11 rates).  You must pay an amount of UK Income Tax and/or Capital Gains Tax that is at least equal to the tax that the Charity reclaims on your donations during a tax year (6 April to 5April).
